II. State Legislation (Tallahassee)

A. Preemption of Local Authority

  • Focus on development, land use, and governance

B. Growth Management & Planning

  • SB 180:

    • Previously froze local planning/regulation

    • Helped storm recovery but caused legal and planning issues

  • SB 840:

    • Restores limited local authority post-storms

    • Allows adaptation to flooding and environmental changes

C. Infill Development & Affordable Housing (HB 105)

  • Requires more flexible zoning

  • Expands allowable development in various zoning districts

  • Concerns:

    • Limits local government oversight

    • Treats development as administrative rather than policy-driven

    • May accelerate urban sprawl

  • Includes code enforcement reforms:

    • Sets response standards

    • Allows legal remedies against inconsistent enforcement

D. Property Rights (HB 655)

  • Amends Bert Harris Act
